Terms of Service
These Terms govern your use of Talent Monster. By creating an account or using the platform, you agree to them.
1. Who we are
Talent Monster (“Talent Monster,” “we,” “us,” or “our”) is an online marketplace operated by Shree Infosystems that helps clients post work and professionals (freelancers) offer services, collaborate in WorkStreams, and arrange project payments through Escrow.com.
We provide software and marketplace tools. We are not the employer of professionals, not a staffing agency, and not a party to the service agreement between a client and a professional for project work.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Talent Monster. By registering, you confirm that the information you provide is accurate and that you will keep it up to date.
3. Accounts
One account may be used both to hire (as a client) and to offer services (as a professional). You are responsible for safeguarding your login credentials and for all activity under your account.
You may sign in with email and password. Where available, Google sign-in may be used to access an existing verified account. You must not create accounts for others without permission, impersonate anyone, or share access in a way that violates these Terms.
We may suspend or terminate accounts that violate these Terms, abuse the marketplace, attempt payment fraud, or create risk for other users or for us.
4. The marketplace
Talent Monster lets clients publish project listings, professionals submit proposals, parties message each other, and — after a proposal is accepted — collaborate in a WorkStream (messages, tasks, deliveries, and related tools).
Clients and professionals decide scope, price, timeline, and quality standards between themselves. Listings, proposals, profiles, and messages are user-generated. We do not guarantee that any project will be funded, completed, or paid, or that any professional or client will meet your expectations.
5. Platform fees and wallet credits
Using certain features requires prepaid wallet credits on Talent Monster. Credits are used only for platform fees charged by us — for example, publishing a project listing and submitting a proposal. Current amounts are shown on our Pricing page and in the member dashboard at the time you take the action.
You may add funds to your wallet (for example via PayPal when enabled). Welcome or promotional credits may be granted at our discretion (for example after email verification).
Non-refundable wallet funds
All amounts added to your wallet — including purchases, top-ups, and any remaining balance — are non-refundable and cannot be withdrawn for cash or transferred off the platform. Wallet funds may be used only for eligible fees and charges on Talent Monster. Closing or deleting your account does not entitle you to a refund of unused credits.
Wallet credits are not bank deposits, stored-value e-money for third-party spend, or a payment method for project fees owed between clients and professionals. Project payments are handled separately through Escrow.com as described below.
For completed engagements, we may also charge a platform fee related to the job (for example a percentage of the agreed proposal amount, currently disclosed in product screens and pricing materials). That fee is separate from Escrow.com’s own service charges.
6. Escrow.com project payments
When a client and professional agree to work together through Talent Monster, project (job) payments are arranged through Escrow.com, a third-party escrow service.
Escrow payments are solely between the client and the professional. Talent Monster is not the buyer or the seller of the work, does not take custody of project funds, and is not a party to the payment relationship for those funds — except that we provide the marketplace and collaboration tools that help the parties connect, agree, deliver, and initiate or track Escrow.com transactions from the platform.
The service contract for the work (scope, deliverables, acceptance, and payment terms between you and the other user) is between client and professional. Escrow.com’s terms, fees, inspection periods, dispute processes, and policies govern how funds are held and released. You must comply with Escrow.com’s requirements to fund, ship, accept, or release payment.
We may display Escrow status and links inside WorkStreams for convenience. That does not make us a party to the Escrow transaction or liable for Escrow.com’s performance, delays, chargebacks, or dispute outcomes.
7. Acceptable use and prohibited activity
You must use Talent Monster only for lawful purposes. You agree not to:
- Post, share, or solicit inappropriate, obscene, pornographic, hateful, harassing, threatening, defamatory, or otherwise harmful content
- Use the platform for illegal activity of any kind — including (without limitation) trafficking or sale of drugs or controlled substances, weapons dealing, fraud, identity theft, money laundering, terrorist financing, or other financial crime
- Attempt to hack, probe, disrupt, overload, or otherwise harm the platform, our infrastructure, security, accounts, data, or other users’ assets
- Introduce malware, scrape abusively, circumvent fees or access controls, or reverse engineer the service except as allowed by law
- Misrepresent skills, budgets, identity, payment status, or affiliation
- Spam, run unauthorized advertising, or share others’ personal data without a lawful basis
- Post unlawful, misleading, fraudulent, or infringing content
Enforcement — removal and no refunds
If you post inappropriate content, attempt to harm the platform or its assets (including by hacking or similar attacks), or engage in illegal activities such as drug sales, money laundering, or other prohibited conduct, we may immediately suspend or permanently remove your account without prior notice. In those cases you are not entitled to any refund of any kind — including unused wallet credits, platform fees already paid, welcome or promotional credits, or any other amounts associated with your account.
We may remove content, cooperate with law enforcement, and take other steps we reasonably consider necessary. Clients and professionals remain responsible for tax, licensing, and legal compliance in their jurisdictions for the work they buy or sell.
8. Content and intellectual property
You retain ownership of content you upload (profiles, proposals, messages, files, portfolio items). You grant us a worldwide, non-exclusive license to host, display, and process that content as needed to operate the marketplace (including public profiles you enable and project listings you publish).
Ownership of work product between client and professional is determined by their agreement — not by these Terms, except that using Talent Monster does not transfer ownership of deliverables to us.
Our branding, software, and site design are owned by us or our licensors. You may not copy or reverse engineer the platform except as allowed by law.
9. Third-party services
The platform integrates or links to third parties such as PayPal (wallet top-ups), Escrow.com (project payments), and optional sign-in providers. Their terms and privacy practices apply when you use those services. We are not responsible for third-party sites or outages outside our reasonable control.
10. Disclaimers
The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that listings, users, or Escrow outcomes will meet your needs.
11. Limitation of liability
To the fullest extent permitted by law, Talent Monster and Shree Infosystems are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunities arising from your use of the platform or from dealings between clients and professionals.
Our aggregate liability related to the service is limited to the greater of (a) the platform fees you paid us (wallet / listing / proposal / disclosed job platform fees) in the three months before the claim, or (b) USD $50 — excluding any amounts paid between users via Escrow.com, which are outside our custody.
Nothing in these Terms excludes liability that cannot be limited under applicable law.
12. Indemnity
You will defend and indemnify us against claims arising from your content, your projects or proposals, your breach of these Terms, or your disputes with another user or with Escrow.com or PayPal, except to the extent caused by our willful misconduct.
13. Suspension and termination
You may delete your account in settings where that feature is available. We may suspend or terminate access for violations (including section 7), legal risk, or prolonged inactivity. Unused wallet balances remain non-refundable as stated in sections 5 and 7. Provisions that by nature should survive (fees, Escrow framing, IP, disclaimers, liability limits, indemnity, enforcement) survive termination.
14. Changes
We may update these Terms and platform fees. Material changes will be reflected on this page with an updated date. Continued use after changes take effect constitutes acceptance. If you do not agree, stop using the service and delete your account.
15. Reviews and ratings
After a proposal’s Escrow.com payment is released (the proposal is closed), the client may leave one review of the professional for that proposal. Reviews include a written comment and a 1–5 star rating.
Displayed profile ratings are calculated from the last year (365 days) of review activity only. If a professional has no reviews in that window, their profile shows as unrated (no stars displayed). Older reviews may still appear in the review history on the profile, but they do not count toward the current average rating.
Reviews must be honest and not abusive. We may remove reviews that violate these Terms or applicable law.
